Terms of Service

1. Acceptance of terms
By creating an account or using Zivlo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.
2. Description of service
Zivlo provides waitlist management software, including tools to create waitlist pages, collect signups, manage referral programs, and send broadcast emails. Features and plan limits are described on our pricing page.
3. Acceptable use
You agree not to use Zivlo to:
- Collect email addresses without the explicit consent of subscribers.
- Send spam, unsolicited commercial messages, or deceptive communications.
- Impersonate any person, company, or brand you do not represent.
- Violate any applicable law, including privacy laws (GDPR, CAN-SPAM, CCPA).
- Attempt to reverse-engineer, scrape, or abuse the Zivlo infrastructure.
- Resell or sublicense access to the Service without written permission.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
4. Accounts and billing
You are responsible for maintaining the security of your account credentials. Subscription fees are billed in advance on a monthly or annual basis via LemonSqueezy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by law.
5. Your content and data
You retain all rights to the content you create and the email addresses you collect through Zivlo. By using the Service, you grant Zivlo a limited license to store, process, and transmit your content solely to operate the Service. We do not claim ownership of your data and will not use your subscribers' email addresses for our own marketing.
6. Account termination
You may delete your account at any time from the account settings page. We may terminate or suspend your account immediately for violations of these terms, fraudulent activity, or non-payment. Upon termination, your waitlist data will be retained for 30 days to allow for export, then permanently deleted.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.
8. Limitation of liability
To the maximum extent permitted by law, Zivlo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Governing law
These terms are governed by the laws of the jurisdiction in which Zivlo is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via email or dashboard notice with at least 14 days' notice before taking effect. Continued use of the Service after changes constitutes acceptance.
